These are the rules for using You Witch!, an online party game. By playing, or by buying credits, you agree to them. If you do not agree, please do not use the game. How we handle your information is in the privacy policy.
You Witch! is run by Clark Lavery, a sole trader in the United Kingdom. Contact: contact@youwitch.app.
You can play without an account. You must be at least 13, and if you are under the age of digital consent where you live you need a parent or guardian’s permission. You are responsible for the name, photo and anything else you put into a game. Do not use the game to harass anyone, to show anything unlawful, or to upload a photo of someone who has not agreed to it. Games run between players’ devices, so we cannot see or moderate them, and a host or other player may behave badly: use the game with people you know.
Adding a photo is optional. Only upload a photo that you have the right to use and that shows someone who is happy for it to be used (you, or a pet, or a drawing). The photo terms you tick before adding one say exactly where it goes. Portraits are made by an AI model, so they can be odd, unflattering or wrong, and the ingredients are meant to be silly and sometimes grotesque. We do not promise any particular result. The finished portrait is shown to everyone in your game, who can save it. You keep your rights in your own photo and portrait, and you give us permission to process them only to make and show the portrait, as described in the privacy policy.
Making a portrait costs credits. Credits are held on your Witch Pass, which is yours to recover with the email or Google account you attach to it. Credits are a way of paying for the game, not money: they have no cash value, cannot be exchanged for money (except as described under “Refunds”), and cannot be transferred or sold. Keep your pass and its codes private. If someone else uses your pass we are not able to replace the credits they spend.
Prices are shown in the pack list in the app, in the currency offered to you, and include any tax that applies. Payment is taken by Stripe, which may act as the seller of the credits for tax purposes. You will get a receipt by email if you gave one. We never see your card number.
If you have not used the credits from a purchase, you can ask for a refund of that purchase within 14 days of buying it, by emailing contact@youwitch.app from the address on your pass. Credits you have already spent are not refundable, because the portrait has been made, and you agree that we may start supplying them as soon as you spend them. This does not affect your legal rights. If something you paid for did not work (for example you spent credits and no portrait could be made), tell us and we will restore the credits or refund them.
You can delete your account in the app. Your email and sign-in details are then removed. Any credits left are not lost: they are kept behind a one-time code that is shown to you when you delete, and that anyone holding it can use to claim them. Keep the code safe. If you lose it we cannot recover the credits.
We work to keep You Witch! running, but it is a small, free-to-try game and we do not promise it will always be available, error-free or unchanged. Games depend on your connection and other players’ devices. We may change, pause or stop features, and may change the price or size of credit packs for future purchases; credits you already hold keep their value. If we ever shut the game down we will give notice and refund credits that are unused.
The game, its artwork, writing and code belong to us or are used with permission. You may play it, but you may not copy it, sell it, scrape it, or attack or overload the service. We may suspend a pass or block access if these terms are broken, and where that is not because of anything you did we will refund unused credits.
Nothing here limits any liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud, or your legal rights as a consumer. Beyond that, we are not liable for losses that were not a foreseeable result of our breaking these terms, nor for what other players do or share in a game, and our total liability to you for any claim about the game is limited to what you paid us in the 12 months before it.
If these terms change in substance we will update the date above and, where it matters, ask you to agree again. Using the game after that means you accept the new terms. These terms are governed by the law of England and Wales, and the courts there can decide disputes, except that if you live elsewhere in the UK you can also use your local courts, and any mandatory consumer rights where you live still apply.
